1. Acceptance of Terms

By accessing or using the BIOS Hydration website (bioshydration.com), mobile applications, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

BIOS Hydration, LLC ("BIOS Hydration," "we," "us," or "our") reserves the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to use this Service or make purchases. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

3. Products and Services

3.1 Dietary Supplement Products

BIOS Hydration offers dietary supplement products including electrolyte drink mixes. All products are dietary supplements as defined under the Dietary Supplement Health and Education Act of 1994 (DSHEA) and are not intended to diagnose, treat, cure, or prevent any disease.

3.2 Pre-Orders and Crowdfunding

Certain products may be offered on a pre-order or crowdfunding basis prior to commercial availability. By placing a pre-order or backing a crowdfunding tier, you acknowledge and agree that: the product is not yet manufactured or commercially available; estimated delivery dates are projections and not guaranteed; product specifications, formulations, and packaging may change before final production; BIOS Hydration will make commercially reasonable efforts to fulfill all orders; and refunds for pre-orders are available upon request prior to product shipment.

3.3 Pricing and Payment

All prices are listed in U.S. dollars. We reserve the right to change prices at any time without notice. Payment is processed through Stripe, Inc. and is subject to Stripe's terms of service. You are responsible for providing accurate payment information.

4. Intellectual Property Rights

4.1 Ownership

All content on this website — including but not limited to text, graphics, logos, images, audio clips, video clips, data compilations, software, and the compilation thereof — is the property of BIOS Hydration, LLC or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

4.2 Trademarks

BIOS HYDRATION™, BIOS BASE™, BIOS RECOVER™, BIOS BUILD™, the BIOS DNA-droplet logo design, and "Hydration Engineered for Life"™ are trademarks of BIOS Hydration, LLC. Federal trademark registration is pending with the United States Patent and Trademark Office. These marks may not be used in connection with any product or service that is not offered by BIOS Hydration, LLC, in any manner that is likely to cause confusion among consumers, or in any manner that disparages or discredits BIOS Hydration, LLC.

4.3 Third-Party Trademarks

All other trademarks, registered trademarks, service marks, trade names, product names, and logos appearing on this website are the property of their respective owners. Reference to any third-party products, services, processes, or other information by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation by BIOS Hydration, LLC.

4.5 Patent Notice

BIOS Hydration, LLC does not claim exclusive patent rights to the SGLT1 sodium-glucose cotransport mechanism, which is a naturally occurring biological process. Our proprietary formulations represent unique combinations of ingredients at specific ratios developed through independent research. BIOS Hydration does not knowingly infringe upon any valid United States or international patents. Any claims regarding the novelty of our specific formulations are limited to the particular combinations and ratios used in our products.

5. User Conduct

You agree not to: use the Service for any unlawful purpose; reproduce, duplicate, copy, sell, or exploit any portion of the Service without express written permission; use any automated system to access the Service; attempt to gain unauthorized access to any portion of the Service; interfere with or disrupt the Service; impersonate any person or entity; or collect personal data about other users without their consent.

6. Disclaimer of Warranties

THE SERVICE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIOS HYDRATION, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. IN NO EVENT SHALL BIOS HYDRATION'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify, defend, and hold harmless BIOS Hydration, LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: your use of the Service; your violation of any term of these Terms; your violation of any third-party right; or any claim that your use of the Service caused damage to a third party.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.

10. Refund and Cancellation Policy

Pre-Orders: Pre-orders may be cancelled and refunded in full at any time prior to product shipment.

Crowdfunding Pledges: Crowdfunding tier pledges are processed as pre-orders. Backers may request a full refund at any time before the product ships. In the event that a product cannot be delivered, all backers will receive a full refund.

Standard Returns: Products may be returned within 30 days of delivery for a full refund, provided they are unopened and in original packaging. Opened products may be returned within 30 days if you are unsatisfied, subject to a restocking fee of 15%.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, such provisions shall be deleted without affecting the remaining provisions herein.
